On December 12, 2018, the United States Senate approved an updated version of the Farm Bill, which ultimately made the hemp plant (a variety of marijuana) 100% legal in our country. Thanks to the efforts of Senate Majority Leader Mitch McConnell and a horde of advocates, this industrial product can once again be farmed for the production of textiles, rope, and additional materials in the U.S. However, as expected, scientists have also taken interest in hemp for legal CBD production (for medical purposes). While you would initially think this process would be permittable (seeing that hemp is now legal), officials are still labeling CBD oil as an illegal substance. What else can we expect for the future? Let’s take a closer look and find out some more information.

Selling Unapproved Products

Despite the recent victories with hemp, members of the industry still have to work hard to accomplish the task of winning the legal status for the little green plant. Although President Trump approved the Farm Bill, this plant is still not considered a dietary supplement or a food, even though it is labeled as a valid agricultural crop. Keep in mind that CBD (an active cannabinoid in hemp plants) is used to produce a seizure medication called Epidiolex (for seizures). So, why is there such a problem?

Confrontations with the FDA

Following the signing of the Farm Bill, FDA Commissioner Scott Gottlieb reconfirmed that his agency is standing by the fact that CBD oil is still an illegal substance and will not be recognized as a food or dietary supplement. However, the FDA did proclaim that certain aspects of hemp are still completely safe for human consumption, but hemp-supporters are still up in arms about this issue. One lobbyist, Courtney Moran, is planning to team up with an Oregon Democrat to make sure the FDA changes their minds about this substance. In the meantime, all we can do is watch and wait to see what happens next.
