Sometime this week, President Donald Trump will be signing the 2018 Farm Bill, hereby legalizing the hemp plant (a variety of marijuana that does not make you high), but that leaves one very important question rattling in the minds of cannabis lovers: will CBD be legal too? Over the course of several years, medical professionals have developed a string of research on this cannabinoid’s anti-seizure and cosmetic potential (plus much more). So, since it is not an addictive substance and is contained in huge amounts in hemp, does that mean CBD will be legal too? Fortunately, we can say that CBD will no longer face as much federal enforcement, but the government will still be holding the reins very tightly on this bridle. Let’s take a closer look at the future of CBD thanks to the 2018 Farm Bill.

Just a Commodity

Based on the 2018 Farm Bill, the United States Department of Agriculture will list hemp (a variety of the Cannabis sativa plant, with a THC count of less than 0.3%) as a commodity crop that would still fall under federal regulations. Needless to say, professionals like Pulak Sharma (co-CEO of Kazmira, a company that focuses on CBD production) was very pleased with the outcome of this decision. Now that hemp is legal, medical professionals and researchers from a variety of fields can explore the potential benefits of this little herb without a cause for alarm.

I Am Not Quite Legal!

Needless to say, the marijuana community is not preparing to confetti and balloons for their celebration quite yet, as CBD is still restricted under federal law. At this time, the DEA still lists this cannabinoid as a Schedule-I (controlled) substance, given the fact that this substance can still alter a human’s brain. However, a March 2016 DEA clarification did state that small amounts of CBD extracted or drawn from the hemp plant was 100% legal. Overall, this is a very confusing situation for farmers and business owners alike.
